Terms & Conditions of QIXIN
Before using QIXIN products, please carefully read and understand these Terms & Conditions and QIXIN's Privacy Policy. These Terms & Conditions constitute a legal agreement between you and Shenzhen QIXIN Technology Co., Ltd. ("QIXIN") regarding your use of QIXIN products and related software (collectively, the "Products"). By using the Products, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.
1. General Provisions
QIXIN may update these Terms & Conditions when reasonably necessary, including due to changes in applicable laws and regulations, security requirements, technical developments, service adjustments, or other legitimate business reasons.
Material changes that may significantly affect users' rights or obligations will be communicated through appropriate channels.
Users are encouraged to review the latest version of these Terms & Conditions through the "About" section of the Application. Continued use of QIXIN Products or Services after the effective date of updated Terms & Conditions indicates acceptance of the updated Terms & Conditions to the extent permitted by applicable laws.
2. Usage Specifications of the Service
2.1. Ensure you can get all the functions and content of QIXIN, you need to register a QIXIN account. The QIXIN account can be registered through an email account. And if you wish, to acquire the hardware and software of QIXIN.
2.2 The QIXIN account is provided and managed by QIXIN. Users obtain a limited, personal, and non-transferable right to use the account.
The account may only be used by the original registered account holder and may not be donated, borrowed, leased, transferred, sold, or otherwise provided to any third party.
Any use of the QIXIN account by a person other than the registered account holder is prohibited unless expressly authorized by QIXIN.
2.3 You can register account at the Application and use the information contained on them, if such right of yours is not restricted by the provisions of applicable legislation (including, but not limited to requirements for the user's age and legal capacity). By agreeing with these Terms & Conditions, you confirm that you have the right to make an autonomous decision concerning the use of Services, or that you use the Services with the consent of your legal representative. In the event QIXIN becomes aware that you are using the Services without having such right or in violation of provisions of these Terms & Conditions (e.g., interfere with the normal operation of QIXIN, violate the legitimate rights and interests of other users or third parties and other bad behaviors), we have the right to cancel your account, including all data of the user, or otherwise restrict your ability to use the Services.
2.4 The user is responsible for keeping the registered account information and account password safe, and the user needs to take legal responsibility for the behavior under the registered account and password. The user agrees not to disclose account and password information to others under any circumstances. When you suspect that others are using your account, you should notify QIXIN immediately. If you use an existing QIXIN account to assist in registering a new QIXIN account, QIXIN may require you to use the aforementioned "existing QIXIN account" to perform related auxiliary operations, including but not limited to auxiliary operations for the purpose of ensuring the security of your account. Log in, retrieve password, freeze account, submit appeal, etc. If you have bound your new QIXIN account with the aforementioned "existing QIXIN account" with a different mobile phone number, the aforementioned "existing QIXIN account" will lose the ability to perform relevant auxiliary operations for the new QIXIN account, and this behavior cannot be Reversal, you should operate with caution.
2.5 QIXIN is not responsible for any content created or posted by users on the website and/or application (including, but not limited to the Ads, comments, personal messages, subjects of discussions, files, links, etc. uploaded by users). And users assume all and any liability for such actions, and ensure that the nature of posted content is not illegal or legally restricted, incorrect, misleading, defamatory, threatening, discriminating, fraudulent, pornographic, inciting national, ethnic, racial or religious hatred, or otherwise infringing rights of individuals. QIXIN has the right (but is not obligated to do so) to check, at its own discretion, the content received from the Service user and transmitted further in order to identify any unwelcome content or any content infringing these Terms & Conditions in the context of using the Services, and to remove such content at its own discretion without a separate notice as well as cancel such user's access to the Services.
2.6 QIXIN is not involved in any purchase, sale, exchange, or other transaction offered by you or other users of our services. Please note that the content created by you or other users of the Services (opinions, offers, etc.) does not constitute an offer from QIXIN to enter into a transaction. It does not create any obligations or otherwise bind QIXIN. QIXIN is not and may not be considered an intermediary between you or other users of the Services, your authorized person, surety, or otherwise associated with the content created by any user of the Services.
3. Products Usage Service Provision
3.1 QIXIN products provide vehicle-related services and functions, including but not limited to vehicle diagnostics, configuration, and hidden feature activation, depending on vehicle compatibility and supported models.
3.2 By accessing QIXIN cloud services, you acknowledge that certain information may be collected, stored, processed, and transmitted by QIXIN for the purpose of providing, maintaining, improving, and securing the Services. Such processing will be conducted in accordance with QIXIN's Privacy Policy.
3.3 Reservation of rights: All other rights not expressly authorized in these Terms & Conditions are owned by QIXIN. When you use other rights, you must obtain the written consent of QIXIN.
3.4 You are responsible for the loss directly or indirectly caused to you or others due to your non-compliant use of the product guidelines. QIXIN is not responsible for this. If your irregular behavior directly or indirectly causes QIXIN's loss, QIXIN has the right to claim compensation from you in accordance with the law, and its irregular behaviors include but are not limited to the following behaviors:
3.4.1 Do not follow the operating steps, or perform functions that do not meet the operating conditions, such as: reading vehicle data without pulling the handbrake, starting the engine illegally, programming while the vehicle is running, etc.
3.4.2 Use a function of a non-corresponding model of their vehicle.
3.4.3 Modify or repair the product by yourself, delete, modify, destroy or reverse engineer the software on the product, such as disassembly, decompilation, etc.
3.4.4 Conduct any act of destroying, stealing, or damaging intellectual property rights of products and software;
3.4.5 The vehicle is used in a dangerous area or in a crowded place;
3.4.6 Use the function of this product beyond the technical specifications, such as: exceeding the use distance, exceeding the use voltage, etc.;
3.4.7 Use the function of this product on the modified parts.
3.4.8 Other acts that directly or indirectly lead to the loss of QIXIN.
3.5 Any vehicle customization or modification performed through QIXIN Products is initiated by the user at their own discretion and responsibility.
QIXIN does not recommend modifications that may create safety risks or violate applicable laws, regulations, or vehicle manufacturer requirements.
Users shall be solely responsible for any consequences resulting from illegal, unsafe, or unauthorized vehicle modifications, including but not limited to the following:
3.5.1 Modifying the seat belt reminder time, or even turning off the seat belt reminder, may lead to major safety hazards;
3.5.2 Modifying the driving can play video, which may lead to distracted driving and accidents;
3.5.3 Modifying the door to open the door does not interrupt the lifting and lowering of the windows, which may result in pinching injuries.
3.5.4 Modifying the internal circulation of the air conditioner without interruption may cause a risk of suffocation.
3.5.5 Modifying the memory automatic start-stop status, startup screen, ambient lighting, etc., may cause driver distraction.
4. Liability
4.1.QIXIN reminds users that improper use of diagnostic, coding, or customization functions may affect vehicle systems, software, or settings and may result in unexpected behavior, system errors, or failures.
Users should fully understand and accept these potential risks before using the Products.
4.2. Users are solely responsible for ensuring that their use of QIXIN Products complies with applicable laws, regulations, vehicle manufacturer requirements, and these Terms & Conditions.
Any consequences arising from unauthorized, illegal, or improper use shall be the responsibility of the user.
4.3. Safe driving remains the sole responsibility of the driver at all times. Users must not operate or adjust vehicle functions in a manner that may distract from safe driving.
To the extent permitted by applicable law, QIXIN shall not be responsible for accidents or damages caused by unsafe driving behavior.
4.4. Permit QIXIN to use your reports: In order to promote product improvement, the user hereby allows QIXIN to use the reports generated by your products that have been uploaded to the cloud server, to process and collect relevant data such as vehicle inspection and maintenance, and to improve related services fair use.
4.5. If the normal operation of the product is affected by a force majeure event, QIXIN and its cooperative units promise to cooperate with the relevant units in the first time to deal with and repair it in a timely manner, but QIXIN will not be responsible for all losses you suffer as a result.
4.6. You know that changing or repairing products or installing or using third-party software by yourself may lead to unpredictable risks, and all legal liabilities and disputes arising therefrom have nothing to do with QIXIN.
4.7. You know and confirm that if you use cloud storage services, you will need to use Internet services in the process, which may be affected by unstable factors in various links. Therefore, there is a risk of service interruption or failure to meet your requirements due to force majeure, computer terminal virus or hacker attack, system instability, user location, user shutdown, and any other technical, Internet, communication line reasons, etc. You must bear the above risks and QIXIN does not guarantee.
4.8. When you use the product, you shall bear the following risks including but not limited to uncontrollable risks from QIXIN:
4.8.1 Risks of loss or leakage of personal information due to irresistible factors;
4.8.2 You must select the software version suitable for the product you are using, otherwise, any software problems or damages caused by the incompatibility between the software and the product shall be borne by you;
4.8.3 You should use the product strictly according to the product and software operation prompts, otherwise any problems or damages directly or indirectly caused by your irregular operation shall be borne by you.
4.9. QIXIN hereby reminds:
4.9.1 The use of products and software must comply with relevant local laws and policies, and abide by these Terms & Conditions. You are solely responsible for all the responsibilities arising from your illegal use or violation of these Terms & Conditions, and have nothing to do with QIXIN and its partners; QIXIN and its partners have the right to demand compensation from you if it causes losses to QIXIN and its partners. and have the right to keep relevant records.
4.9.2 You know and confirm that QIXIN provides your personal information in accordance with legal regulations or the requirements of relevant government departments, and QIXIN does not assume all legal responsibilities caused thereby.
4.10. You agree to indemnify and hold harmless QIXIN and its partners and affiliates from any claims, demands or losses, including reasonable attorney fees, asserted by any third party resulting from or arising from your violation of these Terms & Conditions or the relevant terms of service.
4.11 By purchasing the goods, you acknowledge that you are aware and understand that the goods are comply with the standards applicable by the legislation of the issuing country. You also acknowledge that you are aware and understand that each country may impose different requirements on specific goods. You undertake to purchase goods in accordance with the requirements of the legislation in your country. You will bear sole liability and risk for any consequences arising from the acquisition and use of the Goods when such goods are subject to different requirements in your country, or their use and acquisition is prohibited in your country.
4.12 When using the Mobile Application and QIXIN hardware to connect to the SFD (Schutz Fahrzeug Diagnose / Vehicle Diagnostic Protection) and SFA (Software Function Activation) service, you must comply with the following rules:
4.12.1 SFD/SFA services shall only be used for legitimate vehicle-related purposes, including diagnosis, maintenance, repair, configuration, or other authorized vehicle operations. Users are responsible for SFD/SFA activities performed through their accounts, except where such activities result from unauthorized access beyond the user's reasonable control. Any unauthorized forwarding, sharing, or transfer of SFD/SFA tokens or access credentials to third parties is prohibited. Users must comply with applicable data protection requirements relating to vehicle owners or users..
4.12.3 If you use the SFD/SFA service in violation to these Terms & Conditions, applicable vehicle manufacturer terms, including Volkswagen Group SFD requirements where applicable, you may face the following consequences:
4.12.3.1 Wrongful use (e.g. a breach of the SFD Terms & Conditions, exceeding the maximum permissible number of requests, transmitting invalid requests) may result in internal assessments and investigations, in turn leading to the account being blocked and - in the case of fraud - giving rise to legal consequences as well.
4.12.3.2 Unlawful use (e.g. tampering with control units, modifications to vehicles without the consent of the vehicle user / keeper) may immediately result in the user being blocked and the investigative authorities being brought in.
4.12.4 If there is a suspicion that some settings do not work properly after the use of Application, it is highly recommended to contact our customer support firstly.
4.13 Subscription Services (Applicable to subscriptions purchased or renewed on or after the effective date of this update)
4.13.1 QIXIN subscription services apply only to features and vehicle brands currently supported by QIXIN at the time of use.
4.13.2 A VIN Subscription(1 VIN License) provides access for one bound vehicle VIN only. The subscription is limited to the registered vehicle and may not be transferred to another VIN unless otherwise permitted by QIXIN.
4.13.3 All Brands Subscription provides access to supported vehicle brands currently available on the QIXIN platform and does not imply coverage of all vehicle brands available on the market.
4.13.4 The All Brands Subscription (Individual Annually) is intended for personal use only and allows usage across multiple devices and vehicle VINs under the same account, subject to fair use.
4.13.5 The All Brands Subscription (Family Annually) is based on Apple Family Sharing and is only supported on iOS. It allows subscription benefits to be shared within an Apple Family group. The account holder remains fully responsible for all usage under the family group.
4.13.6 Subscriptions are not cross-platform. iOS and Android systems are operated separately and are not interoperable. Even under the same QIXIN account, subscriptions purchased on iOS cannot be used on Android devices, and subscriptions purchased on Android cannot be used on iOS devices.
4.13.7 Unless expressly stated otherwise by QIXIN in writing, subscriptions, including but not limited to A VIN Subscription and All Brands Subscription, do not include a guaranteed or permanent entitlement to SFD (Schutz Fahrzeug Diagnose) or SFA (Software Function Activation) services. Availability of SFD/SFA-related functions depends on third-party vehicle manufacturer authorization systems, technical requirements, regional availability, and other factors beyond QIXIN's reasonable control. QIXIN provides SFD/SFA-related services on a best-effort basis only and does not guarantee continuous availability, unlimited usage, or permanent inclusion within any subscription plan.
4.13.8 QIXIN may provide complimentary SFD/SFA-related services, including but not limited to complimentary SFD unlock sessions, as a current service benefit for certain subscription plans. Such complimentary services are provided according to QIXIN's current policies and do not constitute a contractual guarantee, permanent entitlement, or commitment that the same benefits will continue in the future.
4.13.9 QIXIN reserves the right to adjust, modify, suspend, or discontinue complimentary SFD/SFA-related services based on changes in third-party manufacturer policies, technical requirements, service costs, security mechanisms, regional restrictions, or other circumstances beyond QIXIN's reasonable control.
4.13.10 Subscriptions purchased before the effective date of this update shall not be subject to the newly introduced SFD/SFA limitation terms contained in this section. Any changes, adjustments, or service arrangements relating to existing subscriptions will be handled separately by QIXIN based on the applicable purchase terms, service policies, and relevant circumstances.
5. Safety Information Provision
Before using QIXIN's products, you confirm your awareness and understanding that you may affect your own or others' safety by improper operation, please seriously read and follow below and the QIXIN User Manual referring to use, especially safety information.
5.1 For your own safety and the safety of others, and to prevent damage to the device and vehicles upon which it is used, it is important that the safety instructions presented throughout this manual are read and understood by all persons operating or coming into contact with the device.
5.2 There are various procedures, techniques, tools, and parts for servicing vehicles, as well as in the skill of the person doing the work. Because of the vast number of test applications and variations in the products that can be tested with this equipment, we cannot possibly anticipate or provide advice or safety messages to cover every circumstance.
5.3 It is the automotive technician's responsibility to be knowledgeable about the system being tested. It is crucial to use proper service methods and test procedures. It is essential to perform tests in an appropriate and acceptable manner that does not endanger your safety, the safety of others in the work area, the device being used, or the vehicle being tested.
5.4 Before using QIXIN's products, please always refer to and follow the safety messages and applicable test procedures provided by the manufacturer of the vehicle or equipment being tested. Use the device only as described in User Manual. Read, understand, and follow all safety messages and instructions in User Manual.
6. Use, Restriction and Privacy Protection of User Information
6.1 QIXIN promises that your personal information obtained by QIXIN through QIXIN products will be protected by QIXIN accordingly. QIXIN will collect, use, store and share your personal information in accordance with these Terms & Conditions and the "Privacy Policy" ("Privacy Policy" under "About" of the product). If the contents of these Terms & Conditions on personal information protection conflict with the above-mentioned "Privacy Policy", and these Terms & Conditions does not clearly stipulate the relevant contents of personal information protection, the "Privacy Policy" shall prevail.
6.2 QIXIN takes reasonable measures to protect user personal information through appropriate security technologies and procedures. Except where disclosure is required or permitted by applicable laws, regulations, legal procedures, or described in QIXIN's Privacy Policy, QIXIN will not disclose personal information to unauthorized third parties without user consent.
6.3. In the process of using this service, you may need to provide some necessary information. You agree that QIXIN collects the above information based on the above-mentioned purposes. If you do not provide or provide incomplete information, you cannot use our service or restricted in use
6.4. Under normal circumstances, you can browse, modify and supplement the information submitted by yourself at any time, but for security and identification reasons, you may not be able to modify the initial registration information and other verification information provided during registration. QIXIN has the right to ask you to provide relevant information to prove your identity and authority when you request to browse, modify or supplement the information you submit.
6.5. QIXIN will use various security technologies and procedures to establish a sound management system to protect your personal information from unauthorized access, use or disclosure.
7. QIXIN's trademark information
[QIXIN] and other graphics, characters or their components involved in QIXIN products, as well as other QIXIN logos and their product and service names are trademarks of QIXIN. Without the prior written consent of QIXIN, you may not display or use or otherwise deal with QIXIN's trademarks in any way, and you may not express to others that you have the right to display, use, or otherwise have the right to deal with QIXIN's trademarks.
8. Other terms
8.1. QIXIN solemnly reminds you to pay attention to the Liability in these Terms & Conditions that exempt QIXIN from responsibility and Safety Information Provision. Please read it carefully and consider the risks yourself.
8.2. The partial or total invalidity of any provision of these Terms & Conditions shall not affect the validity of other provisions.
